1. Subject matter of the service

These General Terms and Conditions govern the relationship between The Pilates Movement Berlin and the customer (hereinafter referred to as “the client”) with regard to the agreement, planning, and implementation of Pilates training as part of an individual or group course.
The Pilates Movement Berlin undertakes to provide the client with individual advice and support within the framework of the agreed training. Unless otherwise agreed, training support can only be used by the client personally. The agreed training service is understood to be a time-limited, contractual obligation in accordance with § 611 BGB (German Civil Code).
The Pilates Movement Berlin is available to its clients outside of training sessions from Monday to Friday between 8:00 a.m. and 8:00 p.m. by telephone and email as part of the agreed training support. This does not give rise to any claim to constant availability of The Pilates Movement Berlin.

2. Liability

The Pilates Movement Berlin excludes any liability towards the client for damage that is not based on gross negligence or intentional breach of duty, including that of any vicarious agents. The Pilates Movement Berlin is not liable beyond the provision of its owed services for any failure to achieve the purpose pursued by the client in entering into the contract.
If the client makes use of the services of cooperation partners or other companies or persons referred by The Pilates Movement Berlin, they do so at their own risk. The Pilates Movement Berlin does not assume any warranty for goods and services that the client has received from them.
The Pilates Movement Berlin has business liability insurance to cover any legal liability claims by the client. The client is responsible for insuring themselves against accidents and injuries that may occur during training. The same applies to the direct route to and from the training location.
The client does not need to sign an additional liability disclaimer; acceptance of the General Terms and Conditions is considered part of the contractual agreements.

3. Prices and payment terms

The client will receive a written invoice from The Pilates Movement Berlin, which is payable in full within 14 days. Payment must be made in cash upon arrival or in advance by bank transfer.
If other training or services (e.g., childcare, training support while traveling, etc.) are used, separate rates will be agreed upon in advance. If The Pilates Movement Berlin purchases products (sports equipment, etc.) on behalf of the client, the goods remain the property of The Pilates Movement Berlin until full payment has been made by the client.
The current price list applies. The Pilates Movement Berlin reserves the right to change its pricing and undertakes to notify the client of any changes in writing immediately, at least four weeks before they come into effect.

4. Prevention and cancellation

Both parties acknowledge that agreements and arrangements for booking training sessions are binding, provided they have been confirmed by both parties. This applies to all means of communication used, such as telephone or email. In the event of prevention, the client must cancel as soon as possible, but no later than 24 hours before the start of the training session. Otherwise, the agreed fee for the booked training session will be charged in full. Appointments that are canceled in good time can be rescheduled.

5. Illness and compensation claims

In exceptional cases (illness of the trainer, vacation time, etc.), an equally qualified trainer may take over the training after prior consultation with the client. No compensation claims can be made in the event of a short-term cancellation of training by The Pilates Movement Berlin. Training sessions that have already been paid for will be credited or refunded upon request.

6. Data protection and confidentiality

The client’s personal data will be stored by The Pilates Movement Berlin and used exclusively for the purpose of fulfilling the aforementioned service. The stored data will be deleted upon request, but no later than 24 months after the last booked training session. In all other respects, the provisions of the Federal Data Protection Act apply.
The client undertakes to maintain confidentiality regarding any business and trade secrets of The Pilates Movement Berlin, even after the termination of the framework agreement.
The Pilates Movement Berlin shall maintain confidentiality regarding all information about the client that becomes known in connection with the performance of the training and support measures, even after the termination of the framework agreement.

7. Miscellaneous

The client undertakes to inform The Pilates Movement Berlin of any illnesses, injuries, or existing pregnancies.
Both parties undertake to maintain mutual loyalty and will not make any negative comments about the other party’s person, products, or services, nor will they damage the other party’s reputation or prestige.
The duration of a training session is 60 minutes. Shorter or longer training sessions must be expressly agreed upon.

8. Final provisions

Unless otherwise specified in these General Terms and Conditions, amendments, supplements, and subsidiary agreements must be made in writing to be effective. The written form requirement also applies to the waiver of this form requirement.
Should any of the above provisions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a legally valid provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision.
The place of jurisdiction is Berlin. The law of the Federal Republic of Germany applies.

Cancellation policy:

If you are unable to keep your appointment, please cancel at least 24 hours in advance. Appointments that are not canceled or are canceled at short notice will be considered as having been attended. Appointments that are canceled in good time can, of course, be rescheduled. Unfortunately, this is necessary because we are unable to fill the slots at short notice.
